General provisions

These General Terms and Conditions (the „Terms“) govern the relationship between the contracting parties: the service provider (the „Provider“) on one side and the client on the other, who may be either a consumer or a business (the „Client“).

To the fullest extent permitted by mandatory, generally binding legal provisions, any legal relationship with a Client acting as a business that is not expressly covered by these Terms or by the agreement between the Provider and the Client is governed by the relevant provisions of Act No. 513/1991 Coll., the Commercial Code, as amended, and by related legislation.

Where these Terms and an individual agreement differ, the wording of the agreement prevails. By placing an order, the Client confirms that they have read and accept these Terms, including the complaints procedure that forms an integral part of them, in the version valid and in force at the moment the order is sent.

The Client acknowledges that ordering any of the services offered by the seller does not grant them any right to use registered trademarks, trade names, company logos or patents belonging to the seller or to other companies, unless a separate agreement expressly provides otherwise.

Relationships and any disputes arising under these Terms shall be governed exclusively by the laws of the Slovak Republic and resolved through mediation.

These Terms are published on each of the seller’s websites, so they can be saved and archived.

The cost of using remote communication tools (telephone, internet, etc.) to place an order is charged at the usual rate, depending on the Client’s own telecommunications tariff.

Service agreement

An offer to enter into a service agreement is made when a prospective Client sends an order to the Provider via the online form, by email or by post. The agreement between the Provider and the Client is concluded only once the price of the services has been paid (the „Service Agreement“). The Service Agreement covers the price, the service and its scope as set out in the order description, together with these Terms.

Withdrawal and refunds. The Provider supplies services only. Performance of the ordered services begins as soon as payment is received, and the Client agrees to this. Because work starts immediately after payment, the Provider does not issue refunds, and the Client cannot withdraw from an agreement for services whose performance has already begun.

Complaints. Clients may send complaints to: info@etuls.com. Every complaint will be dealt with within a reasonable time.

To the fullest extent permitted by law, relationships and any disputes arising under the Service Agreement shall be governed exclusively by the laws of the Slovak Republic and resolved through mediation.

Data security and privacy

All personal data is treated as confidential. It is used solely to perform the agreement and for marketing activities, and it is not published or passed to third parties, except where necessary for delivery or payment processing (disclosure of name and delivery address). Personal data that Clients voluntarily provide in order to complete an order and for marketing purposes is collected, processed and stored in accordance with the laws of the Slovak Republic, in particular Act No. 122/2013 Coll. on the Protection of Personal Data, as amended. The Client consents to the Provider collecting and processing this data in order to perform agreements and for the seller’s marketing (mainly commercial communications, telemarketing and SMS) until the Client withdraws that consent in writing by notice sent to the Provider’s address. Electronic notice also counts as written notice for this purpose. The Client has the right to access their personal data and to have it protected.

Prices

All prices are contractual. The prices shown in the online shop are always current and valid. They are final prices, i.e. inclusive of VAT and any other taxes and charges the consumer must pay to obtain the goods, excluding any delivery or similar charges. Promotional prices apply while stocks last or for the stated period.

The original price is the price at which the seller offered the goods or service in its online shop before any bonuses, sales-promotion campaigns or other discounts were applied.

Payment terms

The seller accepts the following methods of payment:

  1. bank transfer in advance,
  2. payment through online banking (card payment online),
  3. payment against an invoice with a due date (only where the conditions for granting credit are met),
  4. payment by credit card issued by a partner company offering instalment purchases.

Final provisions

These General Terms and Conditions are valid and in force from 22 January 2025. The seller reserves the right to amend the Terms without prior notice.
